These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Mayank Shekhar ("Developer", "we", "us", or "our") governing your access to and use of WorthApp ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must not use the App.
01 License Grant
Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on a device you own or control, solely for your personal, non-commercial use.
02 No Warranties — As-Is Disclaimer
THE APP IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.
To the maximum extent permitted by applicable law, the Developer expressly disclaims all warranties, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, title, or non-infringement
- Any warranty that the App will be error-free, uninterrupted, secure, or free of bugs, viruses, or other harmful components
- Any warranty regarding the accuracy, reliability, completeness, or timeliness of any calculations, results, or outputs produced by the App
- Any warranty that the App will meet your requirements or expectations
Financial calculations and results produced by the App are provided for general informational and educational purposes only. They do not constitute financial advice, investment advice, legal advice, tax advice, or any other form of professional advice. You should not rely on the App's outputs for making financial, investment, legal, or any other decisions without independent verification and consultation with a qualified professional.
03 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DAMAGES WHATSOEVER arising out of or in connection with your use of, or inability to use, the App.
This includes but is not limited to:
- Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, data, goodwill, or other intangible losses
- Financial losses of any kind, including losses arising from reliance on the App's calculations or outputs
- Loss, corruption, or inaccessibility of your data stored within the App
- Loss or compromise of your exported backup files after they leave the App's control
- Any damage resulting from unauthorized access to or alteration of your data
- Any other damages, whether based in contract, tort, negligence, strict liability, or otherwise
This limitation applies even if the Developer has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, the Developer's liability is limited to the maximum extent permitted by law.
04 Accuracy of Financial Calculations
The App provides financial calculators as tools for general estimation and educational purposes. The Developer makes no representation or warranty that any calculation, output, figure, projection, or result produced by the App is accurate, complete, current, or applicable to your specific financial situation. You expressly acknowledge and agree that:
- All calculations are mathematical estimations based on the inputs you provide.
- Results may differ from those provided by financial institutions, banks, or licensed financial professionals.
- The App is not a substitute for professional financial advice.
- Any financial decision made based on the App's outputs is made entirely at your own risk.
- The Developer bears no responsibility or liability for any financial decision, loss, or outcome arising from your use of the App.
05 Your Responsibility for Data and Backups
You are solely and exclusively responsible for:
- The security and safety of your device on which the App is installed.
- Any exported backup files generated by the App, once those files are saved to your device's storage.
- Any consequences arising from your storage, sharing, loss, corruption, or unauthorized access to your exported backup files.
- Maintaining your own backup copies of any data you consider important.
The Developer is not responsible for any data loss, corruption, or inaccessibility arising from device failure, App uninstallation, operating system updates, or any other cause.
06 Prohibited Uses
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except as permitted by applicable law.
- Modify, adapt, translate, or create derivative works based on the App.
- Sell, sublicense, rent, lease, transfer, or distribute the App or any rights thereto.
- Use the App for any unlawful purpose or in violation of any applicable local, national, or international law or regulation.
- Remove or alter any proprietary notices, labels, or marks on the App.
07 Intellectual Property
The App and all its contents, features, and functionality, including but not limited to its code, design, text, graphics, and user interface, are the exclusive property of Mayank Shekhar and are protected by applicable intellectual property laws. These Terms do not transfer any ownership rights to you. You receive only the limited license rights expressly stated in these Terms.
08 Indemnification
You agree to indemnify, defend, and hold harmless the Developer, Mayank Shekhar, from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the App, your violation of these Terms, your reliance on any calculation or output of the App, or your violation of any third party's rights.
09 Modifications to the App and Terms
The Developer reserves the right to modify, update, suspend, or discontinue the App or any part thereof at any time, with or without notice, and without any liability to you. The Developer also reserves the right to amend these Terms at any time. The updated Terms will be made available within the App or through the applicable app store listing. Your continued use of the App after any such changes constitutes your binding acceptance of the revised Terms.
10 Termination
This license is effective until terminated. Your rights under these Terms will terminate automatically without notice if you fail to comply with any provision of these Terms. Upon termination, you must cease all use of the App and delete all copies of the App from your devices.
11 Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India. You hereby consent to personal jurisdiction in such courts and waive any objection to jurisdiction or venue therein.
12 Severability
If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if not possible, shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.
13 Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and the Developer regarding your use of the App and supersede all prior agreements, representations, and understandings of any kind between you and the Developer relating to the App.
14 No Waiver
The Developer's failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the Developer.
